Terms of Service

Terms of service details

Important status

These terms are a working draft for local review. They are not approved for production and must be completed with Ecobuild’s legal identity, commercial rules and advice from a UK construction and consumer solicitor.

1. About Ecobuild

Ecobuild is a building and project-coordination company. Where Ecobuild accepts building work, the customer contracts with Ecobuild. Ecobuild may use employed staff and subcontractors to carry out parts of the agreed work while remaining the customer’s contractual point of contact.

The final terms must include Ecobuild’s full legal name, company number, registered office, trading address and VAT status.

2. Enquiries and site visits

Submitting an online enquiry does not require Ecobuild to accept the work and does not by itself create a contract for building work. Ecobuild may request further information, arrange initial attendance for an urgent issue or book a site visit before deciding whether it can provide a quotation.

Any charge for attendance, investigation, survey or quotation must be disclosed and accepted before the appointment is confirmed.

3. Quotations and formation of the contract

Ecobuild will set out the proposed scope, price, assumptions, exclusions and relevant customer responsibilities in its quotation. The approved quotation must state how long it remains valid and how the customer accepts it.

A contract for the work should arise only through the acceptance method stated in the approved quotation and contract documents.

4. Prices and payment

Customers pay Ecobuild for work supplied under the Ecobuild contract. The approved documents must state whether prices include VAT, any deposit or staged-payment schedule, invoice due dates, accepted payment methods and the consequences of late payment.

VAT status, deposit rules, payment stages, refund handling and the payment process remain to be confirmed before launch.

5. Variations

Changes to the agreed work must be reviewed through Ecobuild. Where a variation affects price, scope or timing, Ecobuild will record the proposed change and seek the customer’s approval before additional work proceeds, except where the final terms permit immediate action to address an urgent safety risk.

The approved terms must define valid approval methods and explain how informal discussions on site are handled.

6. Employees and subcontractors

Ecobuild may allocate employed staff or subcontracted specialist teams according to the requirements of the work. The customer’s contract remains with Ecobuild unless a separate arrangement is clearly disclosed and agreed in writing.

7. Customer responsibilities

The customer must provide accurate information, lawful access to the property, relevant permissions and a safe working environment. The final terms must cover utilities, parking, occupants, pets, known hazards, authority to approve work and other project-specific responsibilities.

8. Programme, access and delay

Any proposed dates or programme are governed by the accepted quotation. The final terms must deal fairly with delays caused by weather, materials, hidden conditions, permissions, customer changes and events outside reasonable control.

Ecobuild does not make a general promise of guaranteed completion dates unless a specific signed contract states otherwise.

9. Standards, defects and remedial work

The final terms must accurately describe Ecobuild’s responsibility for carrying out the agreed service with reasonable care and skill, how the customer reports a concern, the inspection and remedial process, and any applicable manufacturer or workmanship guarantee.

The workmanship policy, reporting process and guarantee wording remain to be confirmed before launch.

10. Cancellation

The final terms must set out consumer cancellation rights where applicable, cancellation after work or procurement begins, treatment of bespoke or ordered materials, and any separate rules for commercial customers.

11. Liability

This section must be drafted or approved by a solicitor. It must not exclude rights or liabilities that cannot lawfully be excluded and must distinguish losses caused by Ecobuild from matters outside its reasonable control.

12. Complaints

The approved terms must explain how to make a complaint, Ecobuild’s response process and any available escalation or alternative dispute-resolution route.

13. Residential and commercial customers

The final documents must confirm whether separate terms apply to consumers and commercial clients. Business terms must not be used to reduce protections that apply to consumers.

14. Governing law

The governing-law and jurisdiction wording must be confirmed by the solicitor, taking account of consumer rights and where customers are based.
